What is rescisão trabalhista (employment termination)?
It's the process of ending a CLT contract and the final payment owed to the employee. It includes items like remaining salary, prorated vacation and 13th salary, and may include a notice period and FGTS penalty, depending on who initiated the termination.
What's the difference between employer-initiated termination and employee resignation?
In employer-initiated termination without cause, the company decides to end the contract, and the employee is entitled to a notice period, a 40% FGTS penalty, and can withdraw their FGTS balance and claim unemployment insurance. In a resignation, the employee decides to leave, and none of these three rights apply.
What is the notice period (aviso prévio)?
It's the minimum advance notice (30 days, plus 3 per year worked, up to 90 days) required by law before termination. It can be worked (the employee keeps working during this period) or paid in lieu (the employer pays the value without requiring attendance).
What is the 40% FGTS penalty?
It's a penalty the employer pays when terminating without cause, calculated on the ENTIRE balance already deposited in the employee's FGTS account over the whole contract — not just the last salary.
